La conclusione di Rosenzweig sul diverso modo dell’ebreo e del cristiano di lavorare alla «stessa opera» è una delle pagine più citate della Stella. Dio non può fare a meno di nessuno dei due. Ha dato al primo la vita eterna, accendendo nel suo cuore il fuoco della verità. Ha posto il secondo sulla via eterna, cosicché egli seguirà «fino alla fine» i raggi della sua luce. L’ebreo vede la stella, ma non i raggi. Il cristiano è destinato a vedere (...) sempre ciò che è illuminato, ma non la luce. Diverso sarà dunque il rischio, a partire dalla preghiera per quella «verità intera» che non appartiene in quanto tale né all’uno né all’altro e per questo ha bisogno di entrambi. Il cristiano che cammina «seguendo la corrente del tempo» è esposto alla triplice tentazione della spiritualizzazione del concetto di Dio, della apoteosi del concetto di uomo e della panteizzazione del concetto di mondo . L’ebreo contempla appunto nel suo cuore – ma nel suo cuore soltanto – la fedele immagine della verità. Egli si distoglie così «dalla vita nel tempo», come «la vita del tempo» si distoglie da lui. È significativo che per sottolineare il senso profondo di questo radicamento Rosenzweig ricorra ad un termine così hegeliano come la Erinnerung, che nella conclusione della Fenomenologia è la notte dell’autocoscienza nella quale lo spirito scende, ma per potersi distendere nel tempo facendone il suo tempo e dunque «la verità e la certezza del suo trono». Esaminando le innovazioni formali e sostanziali introdotte nella riforma del matrimonio concordatario, si evidenziano le questioni che continuano a essere oggetto di controversie dottrinali e di sentenze delle corti di giustizia, volte a colmare le lacune e contraddizioni dell’attuale normativa matrimoniale. Il saggio discute la lettura proposta da Francesco Novati della figura di san Francesco d’Assisi, a partire dalla interpretazione di quelle di Dante e Giotto. Alla luce dei rapporti con Gabriele d’Annunzio, la lettura novatiana di Francesco rivela una prospettiva che tende a offrire una visione estetizzante, dannunziana e decadente, immagine della modernità e non sempre aderente al messaggio originario. In questo modo Francesco diviene sostenitore di un progetto di riforma interno alla Chiesa che, con spirito dannunziano, supera (...) il dualismo tra materia e spirito per arrivare quasi a un elogio dell’immanenza. Attraverso una sorta di mitizzazione della figura di Francesco, Novati parla del proprio tempo più che di un personaggio vissuto nel passato. The essay discusses Francesco Novati’s reading of the figure of St. Francis of Assisi, starting from the interpretation of those of Dante and Giotto. In the light of the relationship with Gabriele d’Annunzio, the Novati’s reading of St. Francis reveals a perspective that tends to offer an aestheticising view, which is “dannuntian” and decadent, image of modernity that not always adheres to the original message. In this way, St. Francis purposes an inside reform project of the Church, which, with a “dannuntian” spirit, goes beyond the matter-spirit dualism in order to arrive almost to a praise of the immanence. Nella problematica generale dei rapporti tra Dio e l'uomo rientra il problema del diritto naturale. Tale problema si e manifestato in modo particolare nel secolo XVII come dimostra lo studio di Ugo Grozio (1583-1645). L'attualita delle sue idee e vivo anche oggi sia in Italia che all'estero; Grozio e ricordato soprattutto dai giuristi, nonostante la sua attivita si sia svolta anche in altri campi come dimostra l'opera bibliografica di Meulen J. Ter e Diermanse. Molti studiosi elogiano le sue impostazioni giuridiche (...) come per esempio G.B. Vico che lo chiama iurisconsultus generis humani. D'altra parte ci sono anche molti critici poco entusiasti del suo pensiero e che anzi lo accusano considerandolo l'iniziatore di una nuova corrente dottrinale che rompe la vera linea del diritto naturale iniziata dai greci, perfezionata dai romani e ripresa dalla scolastica. Da tutto questo appare chiaro che non e facile entrare nel pensiero del giurista di Delft. Questo lavoro vorrebbe dare una risposta al problema del diritto naturale e del suo rapporto con Dio. Si vuol vedere come si puo accordare la famosa affermazione una sola volta nel Prolegomena 11 del De iure belli ac pacis, che le norme del diritto naturale alocum aliquem haberent etiam daremusanon esse Deum, aut non curari a beo negotia humanaa la quale sembra separare il diritto dalla Divinita con la convinzione veramente religiosa di Grozio e con i suoi continui richiami all'autorita delle Sacre Scritture, dei Padri della Chiesa e dei teologi. This paper analyses Agamben’s notion of homo sacer, showing how it should not be confined to the field of a negative critique of biopolitics. In his work, Agamben cautiously delineates a positive figure of homo sacer, whom, according to him, we all virtually are. Such figure would be able to subvert the form in which the relation between bare life and political existence has so far been both thought and lived in the West. How and when is this passage from (...) negative to positive sacredness historically accomplished for Agamben? Is such transit after all thinkable? These are the two basic questions he both unintentionally formulates and leaves undecided in his book Homo Sacer . Agamben further elaborates his investigation of biopolitics in the book he dedicates to Saint Paul, The Time That Remains . Chiesa suggests that, in this volume, the figure of homo sacer as earthly hero is transposed onto that of the messianic man. This can only be achieved by means of a detailed Christian—and more specifically Franciscan—development of the ontological notion of ‘form of life’. Problematically enough, Agamben is able to carry out a transvaluation of biopolitics only in the guise of a bio-theo-politics. (shrink)

Several authors have rightly emphasised the evanescent character of biopolitics, and the difficulty in (...) providing a definition of it that could embrace all the conflicting theories of its most celebrated critics and supporters. The present collection is structured around the basic contention that bio-economy, human nature, and Christianity are the three visible contemporary manifestations of the theoretical object/problem of biopolitics in, respectively, Italian post-workerist economics, post-Marxist philosophical anthropology, and post-structuralist ontology. Their alternative to the usual narrative of Bonhoeffer’s life holds that early in his career, long before the crisis of the Confessing Church and the rise of Nazism, Bonhoeffer made a commitment to [End Page 205] Christian pacifism that endured even through the war years and his resistance to Hitler.To argue for this alternative telling, the authors analyze Bonhoeffer’s three main “ethical” texts: the early “Barcelona lectures,” Discipleship, and finally Ethics. On their telling, while the early ethics lectures were theologically deficient, by the time that Bonhoeffer wrote Discipleship he had developed “integration,” which was “the primary theological catalyst for the ethical transition from Barcelona to Discipleship” (129). Discipleship is, they conclude, the pinnacle of Bonhoeffer’s thought, and anything that comes after it, including Ethics, cannot in any fundamental way differ from it.Alongside this diachronic analysis of Bonhoeffer’s main ethics texts, the authors emphasize two letters that Bonhoeffer wrote in 1935 and 1936. In the first, Bonhoeffer asserts that, because of his theology, he is “sometimes perceived as fanatical” (223). The second he wrote describing his “conversion experience” in 1930, in relation to the Sermon on the Mount and “Christian pacifism.” Read singly, these letters are interesting examples of Bonhoeffer’s thought and life of faith. As the authors present the argument, though, the letters comprise a unified narrative and function as an interpretive lens by which the primary texts should be understood. They think that the “fanaticism” of the first letter refers to the faith brought about in the conversion experience described in the second. The “fanaticism” letter is important because in it he asserts that, “if he were to become more ‘reasonable,’ he would have to ‘chuck [his] entire theology’” (223).Because Bonhoeffer wrote that he would have to “chuck” his theology if he made it more “reasonable,” the authors think that the theology that emerged from the conversion experience has a foundational role in his later works. Although treating the elderly occasion the same kinds of ethical issues as treating other patients, specific problems do arise when making decisions for persons, once competent, who no longer can express their values. I examine the problem of decisional incapacity and offer a critique of the principles, such as substituted judgment, and the instruments, such as advance directives, living wills, other instructional directives, as well as surrogate decision-makers.

A philosophical examination of the treatment of logic and God in Lacan's later psychoanalytic theory. In The Not-Two, Lorenzo Chiesa examines the treatment of logic and God in Lacan's later work. Chiesa draws for the most part from Lacan's Seminars of the early 1970s, as they revolve around the axiom “There is no sexual relationship.” Chiesa provides both a close reading of Lacan's effort to formalize sexual difference as incompleteness and an assessment of its broader implications for (...) philosophical realism and materialism. Chiesa argues that “There is no sexual relationship” is for Lacan empirically and historically circumscribed by psychoanalysis, yet self-evident in our everyday lives. Lacan believed that we have sex because we love, and that love is a desire to be One in face of the absence of the sexual relationship. Love presupposes a real “not-two.” The not-two condenses the idea that our love and sex lives are dictated by the impossibility of fusing man's contradictory being with the heteros of woman as a fundamentally uncountable Other. Sexual liaisons are sustained by a transcendental logic, the so-called phallic function that attempts to overcome this impossibility. Chiesa also focuses on Lacan's critical dialogue with modern science and formal logic, as well as his dismantling of sexuality as considered by mainstream biological discourse. Developing a new logic of sexuation based on incompleteness requires the relinquishing of any alleged logos of life and any teleological evolution. For Lacan, the truth of incompleteness as approached psychoanalytically through sexuality would allow us to go further in debunking traditional onto-theology and replace it with a “para-ontology” yet to be developed. Given the truth of incompleteness, Chiesa asks, can we think such a truth in itself without turning incompleteness into another truth about truth, that is, into yet another figure of God as absolute being? Based on an unfinished manuscript by the late philosopher Dallas Willard, this book makes the case that the 20th century saw a massive shift in Western beliefs and attitudes concerning the possibility of moral knowledge, such that knowledge of the moral life and of its conduct is no longer routinely available from the social institutions long thought to be responsible for it. In this sense, moral knowledge--as a publicly available resource for living--has disappeared. Via a detailed survey of main developments (...) in ethical theory from the late 19th through the late 20th centuries, Willard explains philosophy's role in this shift. In pointing out the shortcomings of these developments, he shows that the shift was not the result of rational argument or discovery, but largely of arational social forces--in other words, there was no good reason for moral knowledge to have disappeared. The Disappearance of Moral Knowledge is a unique contribution to the literature on the history of ethics and social morality. Its review of historical work on moral knowledge covers a wide range of thinkers including T.H Green, G.E Moore, Charles L. Stevenson, John Rawls, and Alasdair MacIntyre. But, most importantly, it concludes with a novel proposal for how we might reclaim moral knowledge that is inspired by the phenomenological approach of Knud Logstrup and Emmanuel Levinas. In this paper we study coalitions of indirect stockholders of a company showing that they can have different controlling power, and therefore different relevance in the control problem. We then introduce a suitable classification, and three algorithms to find all the coalitions of all relevances.
